Summary
The Senior Technology Litigation Counsel position will assist with the technical and legal analysis of the inclusion of Dolby technology in third party products, and support the resolution of disputes related to those products. Based in San Francisco, the position reports to Dolby’s Senior Director of Litigation and Enforcement, within Dolby’s overall Intellectual Property Protection team.
Responsibilities
* Support the Intellectual Property Protection team in all aspects of license compliance and enforcement, including pre-litigation dispute resolution efforts, ensuring effective termination, and/or other breach-of-contract matters. * Support day-to-day management of pending commercial and IP enforcement disputes, including both domestic and foreign pre-litigation, litigation and arbitration. Function as an integral member of each litigation team, including close participation with outside counsel in formulating strategy, drafting pleadings, briefs, and managing discovery, including e-discovery. * Develop and execute strategic plans to assert various IP rights (contract, copyright, trademark, patent and know-how) both domestically and abroad, in a variety of procedural contexts. * Assist with non-litigation enforcement matters, including working with various customs offices, investigation and enforcement at trade show events worldwide, use of the Digital Millennium Copyright Act, and other pre-litigation enforcement. * Draft and negotiate settlement agreements related to any of the foregoing. * Occasional management or participation in collections actions, including but not limited to, insolvency and/or bankruptcy proceedings in jurisdictions worldwide. * Educate members of worldwide Intellectual Property Protection team regarding litigation and dispute management best practices. * As needed from time-to-time, assist in Dolby’s handling of other disputes related to a variety of potential matters in support of all of Dolby’s non-licensing businesses as they arise, widely ranging from commercial disputes to other corporate matters. Emphasis on providing practical solutions to enable Dolby’s diverse business teams.
Ideal Candidate
* Juris Doctor degree from top-tier law school, and admitted to practice in at least one US jurisdiction (CA preferred). * 4-6 years post-graduate legal experience, with at least 3-4 years in commercial and IP litigation (patent, trade secret, trademark and/or copyright). Patent or trade secret experience strongly preferred but not required. * Deep experience with commercial litigation, including contract, IP licensing and/or open-source litigation. * Undergraduate or graduate degree in computer science, electrical engineering, or closely related fields, or substantial post-graduate technical work in those areas, including software development or semiconductors. * Strategic approach to practice of law, with ability to formulate and execute legal strategies in support of business goals. * Ability to work independently to formulate and drive execution of legal strategies, including the ability to develop effective working relationships with business leaders across the company.
